How long does each stage of trademark registration take in India?
The clock starts the day you file. Your application number comes the same day, but everything after that depends on how busy the Registry is, whether the examiner raises an objection, and whether anyone opposes your mark. The table gives realistic ranges. Only the deadlines marked as fixed are set by law; the rest are what practitioners commonly report and can move.
| Stage | Typical time | What controls it |
|---|---|---|
| Search and preparation | 1 to 3 days | Your own readiness: exact mark, class, applicant details |
| Filing Form TM-A and application number | Same day (online) | Payment and correct applicant type |
| Formalities check | A few days to a few weeks | Complete documents, correct fee, valid details |
| Examination and examination report | Roughly 1 to 6 months; can be longer | Registry workload, class, how similar your mark is to existing ones |
| Reply to objection | Fixed: one month (30 days) from the report | You and your attorney; a missed deadline can mean the application is treated as abandoned |
| Reply review and show cause hearing (only if needed) | Adds roughly 2 to 8 months | Whether your written reply satisfies the examiner |
| Acceptance and Journal advertisement | About 1 to 2 months after acceptance | Registry publication schedule |
| Opposition window | Fixed: 4 months from the Journal date | The law; it cannot be skipped |
| Registration certificate | About 1 to 2 months after the window closes, if unopposed | Whether a third party filed opposition |
| Renewal | Every 10 years | You must file; the Registry will not do it for you |
Adding it up, a clean application with no objection and no opposition commonly takes about 9 to 18 months. An objection with a hearing pushes it to roughly 14 to 24 months. If someone opposes, expect two to three years or more. These totals are practitioner estimates, not official figures. Some filing firms advertise examination in weeks; treat that as a best case, not a promise.
Where do delays in the trademark registration process come from?
Search and filing
A search before filing does not make the Registry faster, but it removes the most common cause of delay, which is a conflicting earlier mark. Filing is online on Form TM-A, and the application number is issued the same day. From that day you can use the ™ symbol.
Examination and the objection timeline
An examiner checks your mark for conflicts with earlier marks and for absolute grounds, such as a name that is purely descriptive. If there is a problem, you get an examination report. The trademark objection timeline starts here: you have one month from the report to file a written reply. A missed reply can lead to the application being treated as abandoned, so do not sit on it. An extension can be requested on Form TM-M, but it is at the Registrar's discretion.
If the examiner is not satisfied with your reply, you are called for a show cause hearing. Many objections are cleared at this stage, but each round adds months.
Advertisement and opposition
Once accepted, the mark is advertised in the Trade Marks Journal. Anyone can oppose within four months. Most marks are not opposed. If one is, the matter goes through notice, counter-statement and evidence, and that is what turns a one-year process into a multi-year one.
Registration and renewal
After the opposition period ends with no opposition, the Registry issues the registration certificate. Registration lasts 10 years from the date of filing. Renewal is on Form TM-R, and a late renewal with surcharge is possible for a limited period, so diarise it.
What are the trademark fees, and can you fast-track it?
These are the e-filing fees on IP India's fee schedule, charged per class and per mark.
- Form TM-A: ₹4,500 for an individual, startup or small enterprise. ₹9,000 for everyone else (companies, LLPs and so on that do not qualify).
- Expedited examination (Form TM-M, rule 34): ₹20,000 for individuals, startups and small enterprises; ₹40,000 for others. It is online only, and you can request it only after you have an application number. The Rules say an expedited application is ordinarily examined within three months.
- Renewal (Form TM-R): ₹9,000 per class online.
Expedited examination speeds up only the examination step. It does not shorten the objection reply period or the four-month opposition window, so a registration in under about seven months is unlikely even then. Fees are revised from time to time, so confirm on the IP India fee page before paying.
Can you use ™ and sell on Amazon while your trademark is pending?
Use ™ from the day you file. Use ® only after the mark is actually registered. Using ® on a pending mark is misleading and can create trouble for you.
You do not have to wait for registration to start brand protection on marketplaces. Amazon's Brand Registry page says you need an active registered trademark or a pending application, and that you can enrol with a pending application in some cases, subject to country-specific requirements shown after login. Acceptance is at Amazon's discretion and its rules can change, so check the current requirements in your Seller Central account. Pending applications may also unlock fewer tools than a registered mark. Our trademark service includes help enrolling in Brand Registry once your application is filed.
What we'd check in your case
- Whether the name is already taken or too close to a registered mark in your class. We would tell you before you pay the government fee.
- Whether you qualify for the lower fee as an individual, startup or small enterprise, and that the application is filed in the right applicant's name.
- Whether you need the right class, or more than one, for what you actually sell. Each class is a separate fee.
- Whether you actually need expedited examination. If your launch is not tied to Brand Registry, the extra ₹20,000 may not be worth it.
Our trademark registration service starts with an assessment and a fixed written quote, and our packages page shows what is included. If you are still choosing a business structure, read about business registration first, since the applicant name matters for the filing. Send us the brand name on WhatsApp and we will tell you honestly whether to file, and how.
Not sure how this applies to you? Tell us what you sell and where. We'll tell you what you need, and what you don't, in a free 15-minute fit check.

How long do I have to reply to a trademark objection?
You have one month (30 days) from the date of the examination report to file a written reply. An extension can be requested on Form TM-M, but it is at the Registrar's discretion. If you miss the deadline, the application can be treated as abandoned.
Can I use the ® symbol while my trademark is pending?
No. Use ™ from the day you file, and ® only after the registration certificate is issued. Using ® on a pending mark can mislead customers and is best avoided.
Can I get my trademark examined faster?
Yes, through expedited examination on Form TM-M under rule 34, filed online after you have an application number. The fee is ₹20,000 for individuals, startups and small enterprises and ₹40,000 for others, per class. It speeds up only examination, not the opposition period.
What is the opposition period for a trademark in India?
After your mark is advertised in the Trade Marks Journal, anyone can oppose it within four months. If nobody does, the Registry can proceed to registration. If someone opposes, the process can take years.
How often must a trademark be renewed in India?
Every 10 years, on Form TM-R. The online fee is ₹9,000 per class. A late renewal with a surcharge is allowed for a limited period, but it is safer to renew before expiry.
